EssMile Terms of Use (End User License Agreement)

These terms are an agreement between you and ESSPRY LLC ("ESSPRY") for the EssMile mobile app. They also serve as the end-user license agreement (EULA) for Apple App Store users. By downloading, installing or using EssMile you accept them. If you do not accept them, do not use the app. Our Privacy Policy explains how data is handled.

1. License

ESSPRY grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use EssMile on devices you own or control, for your own personal or internal business record-keeping, as permitted by the Apple Media Services Terms or Google Play Terms of Service that apply to you. All rights not granted are reserved. EssMile is licensed, not sold.

You may not copy, modify, reverse engineer, decompile or create derivative works of the app (except where law permits despite this clause), remove proprietary notices, rent or sublicense it, or use it to build a competing service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent where you live). To make purchases you must be old enough to enter into contracts or have a parent or guardian's permission, as required by Apple or Google.

3. Your data

EssMile stores your vehicles, fill-ups and service records only on your device (see the Privacy Policy). You are responsible for keeping that data safe and backed up. ESSPRY cannot recover data lost through app deletion, device loss, device reset, an operating-system problem or a software bug.

4. Free plan, EssMile Pro, subscriptions and trials

• Free plan: includes one vehicle.
• EssMile Pro: an optional, auto-renewing subscription, offered as an annual plan and a monthly plan, that unlocks unlimited vehicles and PDF service-history export.
• Price: the price and billing period are shown in the app and in the App Store or Google Play before you confirm. Taxes may apply.
• Free trial or introductory offer: if a free trial or introductory offer is available, its length and terms are shown on the purchase screen. If you do not cancel before a free trial ends, it converts to a paid subscription at the price shown, and you are charged.
• Payment: payment is charged to your Apple ID or Google Play account at confirmation of purchase (or at the end of the free trial).
• Auto-renewal: your subscription automatically renews for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• Manage or cancel: you can manage and cancel your subscription at any time in your account settings: on iPhone, Settings > your name > Subscriptions; on Android, Google Play > Profile > Payments and subscriptions > Subscriptions. Deleting the app does not cancel your subscription. Cancelling takes effect at the end of the paid period, and you keep access until then.
• Refunds: purchases are made with Apple or Google, which handle billing and refunds under their policies. ESSPRY cannot issue refunds directly. Request refunds from Apple (reportaproblem.apple.com) or Google Play.
• Restore Purchases: if you reinstall or change device, use "Restore purchase" in the app to recover an active subscription tied to the same Apple or Google account.
• Price changes: we may change prices. Apple and Google will notify you and, where required, ask for your consent before a price increase applies to your subscription.
• Unused trial: any unused portion of a free trial is forfeited when you buy a subscription, where the store allows that.
• Future features: Pro includes the features described in the app for your subscription. We may add or change features, and we do not promise any specific future feature.

5. Acceptable use

Do not use EssMile in violation of law, to interfere with the app, the stores or RevenueCat's services, to circumvent or tamper with purchases or entitlements, or to harm others. Do not use EssMile while driving.

6. Important disclaimers

• EssMile is a record-keeping tool. Fuel economy, cost per distance, totals, service due dates and similar figures are estimates calculated from the data you enter. They may be wrong if entries are missing, wrong or partial. They are informational only and are not mechanical, safety, tax, insurance, legal or financial advice.
• Service reminders are conveniences, not safety systems. They may not appear if notifications are off, your phone is restricted, or your phone is off or out of battery. Follow your vehicle manufacturer's maintenance schedule and a qualified mechanic's advice. You are responsible for your vehicle's maintenance and roadworthiness.
• The PDF service history is created from your own entries and is not a certified or verified record.

To the maximum extent permitted by law, EssMile is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing here limits warranties or rights that cannot be excluded by law.

7. Limitation of liability

To the maximum extent permitted by law, ESSPRY, its members, and its suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, missed services, vehicle damage or repair costs, arising from your use of EssMile. ESSPRY's total liability for any claim relating to the app is limited to the greater of the amount you paid for EssMile in the 12 months before the claim and US$50. Nothing in these terms limits liability that cannot be limited by law (for example, for fraud, or death or personal injury caused by negligence), or your mandatory consumer rights.

8. Updates, changes and termination

We may update the app or these terms. For a material change we will update the effective date and, where required, notify you. Continuing to use the app after the change means you accept it. We may end your license if you materially breach these terms. You may stop using the app at any time by deleting it (and cancelling any subscription as in section 4). Sections that by nature should survive termination will survive.

9. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Subject to the next sentence, the courts located in Wyoming have jurisdiction. If you are a consumer, you keep any mandatory consumer-protection rights of the country where you live, including the right to bring a claim in your local courts and the protection of your local mandatory law.

10. Apple-specific terms (App Store users)

• Acknowledgement: this agreement is between you and ESSPRY only, not Apple. ESSPRY, not Apple, is responsible for EssMile and its content.
• Scope of license: limited to use on Apple-branded products you own or control as permitted by the Usage Rules in the Apple Media Services Terms.
• Maintenance and support: ESSPRY is responsible for support. Apple has no obligation to provide maintenance or support. Contact support@esspryllc.com.
• Warranty: if the app fails to conform to any applicable warranty, you may notify Apple, which may refund the purchase price (if any); Apple has no other warranty obligation for the app. Any other claims, losses or costs for failure to conform are ESSPRY's responsibility.
• Product claims: ESSPRY, not Apple, is responsible for any claims relating to the app or your possession or use of it, including product liability, legal or regulatory compliance, and consumer-protection or privacy claims.
• Intellectual property: if a third party claims the app infringes its intellectual property, ESSPRY, not Apple, is responsible for investigating, defending and settling the claim.
• Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist-supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party terms: you must comply with applicable third-party terms (for example your wireless carrier's) when using the app.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you after you accept it.

Apple's standard Licensed Application End User License Agreement applies as a baseline; where it conflicts with these terms on a matter Apple's standard terms govern, Apple's terms prevail.

11. Google Play

If you obtained EssMile from Google Play, Google Play's Terms of Service also apply to your purchase and any refund.
