EssCard Terms of Use (End User License Agreement)

These terms are an agreement between you and ESSPRY LLC ("ESSPRY") for the EssCard mobile app. They also serve as the end-user license agreement (EULA) for Apple App Store users. By downloading, installing or using EssCard you accept them. If you do not accept them, do not use the app. Our Privacy Policy explains how data is handled.

1. License

ESSPRY grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use EssCard on devices you own or control, for your own personal or business networking, as permitted by the Apple Media Services Terms or Google Play Terms of Service that apply to you. All rights not granted are reserved. EssCard is licensed, not sold.

You may not copy, modify, reverse engineer, decompile or create derivative works of the app (except where law permits despite this clause), remove proprietary notices, rent or sublicense it, or use it to build a competing service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent where you live). To make purchases you must be old enough to enter into contracts or have a parent or guardian's permission, as required by Apple or Google.

3. Your data and content

EssCard stores your cards and your notes about people you meet only on your device (see the Privacy Policy). You are responsible for keeping that data safe and backed up. ESSPRY cannot recover data lost through app deletion, device loss, device reset, an operating-system problem or a software bug.

You are responsible for the details you put on your cards and for what you share. Only enter information you have the right to use, and only record notes about other people in line with the law that applies to you, including privacy and marketing rules. Your QR code and vCard file reveal the contact details on that card to anyone who scans or receives them.

Do not use EssCard in violation of law, to put false or misleading identity information on a card, to impersonate others, to send unsolicited or unlawful messages to people you meet, to interfere with the app, the stores or RevenueCat's services, to circumvent or tamper with purchases or entitlements, or to harm or harass others.

6. Important disclaimers

To the maximum extent permitted by law, EssCard is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing here limits warranties or rights that cannot be excluded by law.

7. Limitation of liability

To the maximum extent permitted by law, ESSPRY, its members, and its suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, missed follow-ups or lost business opportunities, arising from your use of EssCard. ESSPRY's total liability for any claim relating to the app is limited to the greater of the amount you paid for EssCard in the 12 months before the claim and US$50. Nothing in these terms limits liability that cannot be limited by law (for example, for fraud, or death or personal injury caused by negligence), or your mandatory consumer rights.

8. Updates, changes and termination

We may update the app or these terms. For a material change we will update the effective date and, where required, notify you. Continuing to use the app after the change means you accept it. We may end your license if you materially breach these terms. You may stop using the app at any time by deleting it (and cancelling any subscription as in section 4). Sections that by nature should survive termination will survive.

9. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Subject to the next sentence, the courts located in Wyoming have jurisdiction. If you are a consumer, you keep any mandatory consumer-protection rights of the country where you live, including the right to bring a claim in your local courts and the protection of your local mandatory law.

10. Apple-specific terms (App Store users)

Apple's standard Licensed Application End User License Agreement applies as a baseline; where it conflicts with these terms on a matter Apple's standard terms govern, Apple's terms prevail.

11. Google Play

If you obtained EssCard from Google Play, Google Play's Terms of Service also apply to your purchase and any refund.
